A premarital agreement, prenuptial agreement or antenuptial agreement are synonymous with each other and are agreements entered into between two people prior to the parties entering a marriage. A form of this type of agreement can even be prepared if two parties intend to reside together indefinitely. Premarital agreements are generally used to protect assets from becoming community property upon marriage or to address the issue of spousal support in the event of divorce. The content of these agreements and their enforceability are outlined in Family Code section 1610, et. Seq.
