Domestic Violence Restraining Orders
California Family Code Section 6320 defines abuse as any of the following:
- Intentionally or recklessly cause or attempt to cause bodily injury;
- Sexual assault;
- Placing a person in reasonable apprehension of imminent serious bodily injury to that person or to another; and
- Engaging in any behavior that has or could be stopped such as stalking, harassing, impersonating, or threatening
If you or someone you know has been the victim of domestic violence or has had a restraining order filed against them, it is imperative that you call Dan to discuss your rights and responsibilities in each instance. The custody of your children, support (money) orders, property division, and even who pays for attorney’s fees can be addressed during these proceedings.
